Public Hearing – Voluntary Annexation

A public hearing will be held at Cabool City Hall, 618 Main Street, Cabool, Missouri, on October 24, 2022, at 5:30 p.m. concerning a request for annexation by the Cabool Second Baptist Church that real property owned by it be annexed by the City of Cabool, Missouri.  At the public hearing any interested person, corporation, or political subdivision may present evidence regarding the proposed annexation.

Mayor Cannon opened the Public Hearing at 5:30 p.m. with the following Aldermen present:  Alderman Roberts, Alderwoman Ellison, Alderman Williams, and Alderman Hale.

Mayor Cannon stated the reason for the Public Hearing and asked if there was any public comment.  There was none.

A motion was made by Hale/Williams to close the public hearing at 5:32 p.m.  Motion carried with 4 ayes and 0 nays.

Call to Order:  Mayor Cannon called the meeting to order at 5:32 p.m. with the following Aldermen present:  Alderman Roberts, Alderwoman Ellison, Alderman Williams, and Alderman Hale

Public Comment:  None

Approval of Agenda:  A motion was made by Hale/Ellison to approve the agenda as presented.  Motion carried with 4 ayes and 0 nays.

  1. YMCA:  No one was present and no written report was provided.

Chamber of Commerce – Rick Bonds: Rick presented a written report to the Board of Aldermen.  He stated the Chamber had spent a lot of money this last quarter, approximately $12,000, however, they did make a lot of it back.  Most of the money was spent on the carnival and advertising.  He reminded everyone that the Chamber luncheon meeting is tomorrow.  He stated several activities are coming up.  The trunk or treat is October 31st from 5:30 to 7:30, and the Christmas Parade is scheduled for December 17th at 4:30 p.m.  The Mayor and Board thanked Rick for his report.  A motion was made by Hale/Roberts to approve the report.  Motion carried with 4 ayes and 0 nays.

 

  1. Cabool Senior Center: A written report had been provided.   A motion was made by Hale/Williams to approve the report.  Motion carried with 4 ayes and 0 nays.

 

  1. Cabool History Society: A written report had been provided.  A motion was made by Williams/Hale to approve the report.  Motion carried with 4 ayes and 0 nays.

 

  1. Cabool Development Foundation: Scheets reported they had met earlier today.  He stated they are waiting for some funds to be moved around to pay the bill for the signs.  He stated they had a good meeting, and there seems to be a lot of things going on.  There is a lot of building in progress, as well as some changes in businesses.  He stated we are very busy.  He gave an update on some grants that had been awarded for the Twin Cities Industrial Park.  The City of Mountain Grove will serve as a pass through on one grant, and the City of Cabool will serve as a pass through on another grant.  A motion was made by Hale/Ellison to approve the report.  Motion carried with 4 ayes and 0 nays.

City Administrator Report

 

                Good afternoon, it sure seems like our year has flown by! We had Auditors here at the end of September, they will be reporting to the Board in November if everything work out like they expect. We don’t think they found any real issues, but we did uncover a couple of glitches that we all feel are a software issue. They did ask for our final numbers from the last budget, and we realized we hadn’t brought those to the Council. It seems like we just did that! That is on the agenda to take care of this meeting.

We are still seeing the developers continue to build, with the one at Woodland Heights purchasing more lots to continue to build. He has 4 homes in process right now, with 2 of those nearing completion. We have another builder that grew up here that is trying to purchase vacant lots and wants to build affordable rental homes. We also have a gentleman that is going to be at the meeting that has purchased 7 acres on Bluebird Ln. and wants to build some small homes there.

We have gotten our Grant documents from DRA for the grant that was applied for by Twin-Cities and will be a pass through for us. The Grant is for $1,000,000.00 for finishing the roads and some storm-water work. We will approve a few documents for that at this meeting as well. There is another DRA grant that was previously approved through Mountain Grove, that grant was for $550,000.00 to connect the Industrial Park Sewer to the municipal system in Mountain Grove.

 

We have more activity in the pipeline, Ron is going to be here Monday night and you can feel free to ask him questions if you wish. It is a very busy time in Cabool Missouri! We are excited to see things progress.

 

BHMG is finishing up our Electric rate study, and should be done with it by the end of October, we will probably have them at our November or December meeting. Great Rivers is also finishing the Water/Sewer study, and we should see them in November.

 

I am finalizing the LLEBG grant and getting the re-imbursement from them, and should see the re-imbursement for the River Bank study very soon as well.

 

At our last meeting I was asked about the Air BnB on Tindel. I have asked around to other communities as to how they are handling those situations, it seems that most are not considering them a home based business, but are making the owners purchase a business license, some have said they do this mainly to allow them to keep track of the situation, in case they need to change ordinances or something in the future.

 

Conway has visited with me about the abandoning of Westwood Dr. that we approved, and I have sent the info to the Title Company to get him info to put in the ordinance. We have had some contact with MIRMA about the pending lawsuit with the lady that fell on the sidewalk, and I think the confusion is getting straightened out. I am going to meet with Chris Rutledge from MoDot and discuss what they have been asked for as well.

 

The Park Department: has slowed down a bit with the cooler weather. They are working on some projects that have been put off for too long. Randy has set his retirement date and will be officially retired on October 26th. Clayton has been doing a good job, and in my opinion is the obvious person to take over that department. He has been gone for a few days hunting, while Randy is still here. He and LB have done well when Randy is not here.

 

The Street Department: has been busy too. Arnold has had his guys doing some concrete work, and picking up a lot of brush, and mowing and trimming along the streets. They have also done some spraying. They have finally gotten the ditch concreted at Lynn Jones residence on Rogers St.        Lynn had been wanting that done for a long time (Lynn is not doing very well). They also did some painting on the streets connecting the Elementary school and the middle school, the school had requested that.

Arnold finally got someone to install the dump bed on the truck we purchased in the spring! BUT! Anymore nothing is ever that simple. He had to take the truck to Little Rock to have the bed installed. We decided we could handle that and needed to get it done. The plan was for him to have the truck there early on Thursday morning and stay one night in a hotel and bring the finished truck back on Friday. That didn’t happen. He took the truck, and they found that the pump on the truck was bad, and couldn’t get the correct pump for a few days. So, Bruce had to go pick Arnold up on Friday. So, we are hoping it will be done by the time we have this meeting and it will be ready to use. Getting things, supplies, equipment, or whatever has been a nightmare, and continues to be.

 

The Electric Department: has been replacing poles and changing out some services. Stacy has been looking at what it is going to take to supply all of the expansion we are seeing. Here is another place that getting our supplies in a timely manner is going to be tough. The wait time on a basic transformer is currently 42+ weeks. Stacy and I have discussed replacing Austin, and Stacy doesn’t want to rush into anything, he wants to be sure we get a quality person. He is getting the guys going on tree trimming also, now that the leaves are getting off the trees.

 

The Water/Sewer Department: Has had a few leaks, and continues to install new meters, they have gotten a lot of those done, over 170. Tyler is continuing his training this month. We are still waiting on a final plat for the land north of Casey’s, as soon as we have that we can get the water and sewer lines moved. I am still talking with the folks that own the property formerly owned by Maxine Hamilton. We need their easement to get sewer on to the North Loop. David Carroll has installed a lagoon for his new house. If we can’t get our easement we will run a line over to Cedar St. along the property line to serve David’s house. We are actively searching for a vac-truck,  and are not finding any that are very close. I have a few guys that deal in bigger truck looking for one for us. There are some out there, up to $500,000, we are trying to find a used one for closer to $50,000.

 

The Shop: All of the departments have been keeping Bruce busy. He has been doing the upfit for the new police vehicle, and just finished it last week. Bruce is always busy with maintenance items for everyone, oil changes, tune-ups, brakes, water pumps, belts, and other things along with fabricating whatever we ask of him.

 

As you can see, we are very busy, it is an exciting time, we are seeing growth that we have worked for for a long, long time. The housing growth actually is something that will cost the City a lot to sustain, but will paid back in the long run.

 

I know we did not mention it at the last meeting, but we did lose a long-time Council Member in Jim Sigman last month. Jim could be a bear to deal with sometimes, but he always had the best interest of Cabool in his heart.

 

On a much lighter note, I would like to congratulate Coach Hale on his induction into the Missouri Sports Hall of Fame. I was able to attend the luncheon this past week, and was proud to see the support from the community and former students, players and fellow coaches for Coach Hale. I know in small towns you hear of someone that is a “fixture” in the community, I think of Mr. Hale that way. I am also thankful that his passion for the community has allowed him to serve on the City Council.

 

Mr. Scheets also reported that the street department had been working on the concrete ditch project by Lynn Jones residence on Rogers Street.  Mr. and Mrs. Jones have been asking for this to be done for many years, and we are happy to get it completed.  The street department has also been hauling brush, putting up new signs, have planted some trees at Montgomery Lake Park, and have stocked the lake with fish.  Arnold took the new dump truck to Little Rock to get the bed installed, and of course they ran into problems.  The pump on the truck was not working, so they are scrambling to find one that will work with the truck and the bed.  We left it there and will go back to get it when they have it done.

 

Mr. Scheets also reported that there is a DRA grant kick off in Mountain Grove tomorrow.  He also stated that he had attended a SCOCOG meeting last week.  There will be a MPUA round table meeting on Friday, from 10 to 2, in Mountain View, if anyone is interested in attending.  Mr. Scheets also stated that we are still having problems with our SAM.GOV account.

Mr. Scheets stated he had been approached by Riley Dotson about purchasing the corner of property behind Casey’s east that is owned by the City.  Mr. Scheets stated this is the small area where the substation used to be.  Mr. Dotson is interested in purchasing this property to possibly install an electric charging station there.  Mr. Scheets asked the Mayor and Board to be thinking about this, and we can talk about it again.

 

Mr. Scheets also stated the holidays are coming up soon and we need to be thinking about what we want to do.

 

Alderman Roberts asked what we had found out about the B & B on Tindel Street.  He wants to know if the area is zoned for that and if they have a business license.  There was also discussion about inspections relating to short term rentals.  Aldermen Roberts stated he feels if they are treated like any other rental that they would have to be inspected every time someone moves in or out.  Mr. Scheets stated that he wasn’t sure, but thought our ordinance stated that inspections on rentals were to be done every 6 or 12 months, not necessarily between every rental.  We can look at the ordinance to see.  City Clerk Kim Elliott stated she thought the owner of the one on Tindel Street had gotten a city license, but would find out for sure.  She also reported that all landlords that have rental properties in town are supposed to get a business license, and several had but several have not.

 

  1. Subdivision Discussion – Bobby Stidham:  Ron Reed introduced Bobby and Wendy Stidham to the Mayor and Board of Aldermen.  They are the people that have bought the former Tod’s Motel property and have made efficiency apartments there.  He stated they have purchased 7 acres out on Bluebird Road, and are interested in developing a tiny/small house subdivision. 

 

Mr. Stidham presented a drawing of the land and the proposed lots.  He stated their plans are to build 32 units.  The lot size will be 100 x 80, and the home size will be 20 x 30, or 600 square feet.  They will be 2 bedroom.  They will put in the appliances and heating and air, etc.  They will be on a concrete foundation, and the homes will be sold.  Alderman Roberts asked what the approximate cost would be for a home and the lot.  Mr. Stidham stated he expected it to be around $75,000.  He stated they do most of the work themselves, and that helps keep the cost lower.  He stated their goal is to provide affordable homes to people that need them. 

 

Mr. Scheets stated that the area is zoned industrial, and that we have already looked at the electric situation, and Stacy seemed to think it wouldn’t be a big deal, and it would all be underground.  Mr. Reed stated the water and sewer is fairly close.

 

Alderman Hale asked what the distance would be from the property lines, as we have a subdivision ordinance in place, and it would need to be followed.  Mr. Stidham stated the homes would be 15 to 20 feet from the property lines.  Mr. Stidham stated he planned to chat the streets, however, our subdivision codes require curb and guttering.  He stated this of course would add to the costs and raise the prices of the homes accordingly.  Mr. Scheets stated that the proposed subdivision would have to go before planning and zoning.  Mr. Reed stated the Stidham’s plans would have to be monitored by the Planning and Zoning Commission.  Alderman Hale stated he didn’t have a problem with it, as along as all the regulations were followed.  Mr. Reed stated he felt this was a good area for this sort of project, as it was away from already established areas and subdivisions.  It was the consensus of the Board of Aldermen for the Stidham’s to move forward with their project, and follow the rules of our subdivision ordinance.

 

  1. Intercounty Electric Agreement:  Scheets stated we had received a renewal for the “Joint Use Agreement” from Intercounty Electric.  We need approved this evening for that agreement to be signed.  A motion was made by Roberts/Hale to approve the Mayor to sign the agreement.  Motion carried with 4 ayes and 0 nays.

Second Reading – Council Bill No. 1101 – Ordinance No. 008-2022:   AN ORDINANCE ADOPTING THE ACTUAL RECEIPTS AND EXPENDITURES FOR THE CITY OF CABOOL, MISSOURI, FOR FISCAL YEAR 2021-2022 BUDGET YEAR, INCLUDING THE GENERAL FUND, WATER AND SEWER FUND, ELECTRIC FUND, AND FIRE/POLICE CAPITAL FUND.  A motion was made by Williams/Hale to introduce the bill for the second reading.  The following roll call vote was recorded:  Roberts – aye, Ellison – aye, Williams – aye, Hale – aye.  Council Bill No. 1101 will become City Ordinance No. 008-2022.

 

  1. Resolution No. 2022-010R: A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE DELTA REGIONAL AUTHORITY AND THE CITY OF CABOOL.  Hawn stated this was a unique resolution that had been provided by the Delta Regional Authority, and we will go through it and record the information, and then it can be typed up and be signedThe blanks were all filled in and the ordinance will be typed up for signature.   A motion was made by Hale/Ellison to approve Resolution No. 2022-010R.  The following roll call vote was recorded:  Roberts – aye, Ellison – aye, Williams – aye, Hale – aye.

 

  1. Board Reports:

Alderman Roberts – asked what the status of the house at Rogers and Ozark is.  Mr.  Scheets stated the new owners were told it had to be cleaned up within a couple of weeks or they would be issued a summons for court.  Mr. Scheets stated since the property has changed hands since we started the condemnation proceedings that we would have to start all over again.  Fire Chief Brent Honeycutt stated they had told him they had planned to tear it down and possibly build a real estate office there. Mr. Scheets stated that our building inspector has been in touch with them several times as well.

 

Alderwoman Ellison – stated she had received a complaint about cars parking along Paul and Walnut Streets and are blocking traffic.  She stated she had driven by several times and did not see any problems.  Police Chief Jerald Sigman stated that parking along streets is permitted as long as they do not block traffic.  Alderwoman Ellison had also received more complaints about stray cats.

 

Alderman Williams – stated the junk store on Main Street was getting a lot of stuff out along the sidewalk again, and he asked about the status on the safety inspection of the building.  Fire Chief Brent Honeycutt stated the fire marshal was supposed to be here the first week of December.  Alderman Williams also asked if we can update our website more often since we don’t have a local newspaper anymore.  Mr. Scheets stated he can easily update it, but someone needs to get the information to him.  Alderman Williams also asked if our telephone situation has been fixed yet.  Mr. Scheets stated that people are still having trouble calling from land lines, however, most people can get through from cell phones.  He stated we have called Centurylink several times and have not gotten anywhere, and Grennan Communications has been trying as well.

 

Alderman Hale – had received a complaint about a large number of cats at a house on Pine Street behind the High School.  The cats are all over the school campus, and have even scratched some kids.

 

  1. Mayor’s Report:

 

Mayor Cannon asked where we are on changing out the water meters.  Mr. Scheets stated they were over half way done, and we are about out of meters, and have more on order.  Of course, we don’t know how long it will take to get them.  It took Kyle about a day and a half to read the water meters that are still in the hand held.

 

  1. Set Date for Next Regular Meeting: Mayor Cannon stated the next regular meeting will be held on Monday, November 21, 2022, at 5:30 p.m.

 

CLOSED SESSION:  Closed Session pursuant to Section 610.021(3) Revised Statutes, Missouri, in regard to the hiring, firing, disciplining, or promoting of an employee.

 

A motion was made by Hale/Williams to adjourn the regular meeting and go into closed session at 6:25 p.m.  The following roll call vote was recorded:  Roberts – aye, Ellison – aye, Williams – aye, Hale – aye.

A motion was made by Hale/Williams to adjourn the closed session and go back to open session at 6:30 p.m.  The following roll call vote was recorded:  Roberts – aye, Ellison – aye, Williams – aye, Hale – aye.

 

A motion was made by Hale/Roberts to make Clayton Steelman the Park Department Superintendent at the rate of $17.00 per hour, with a .50 cent increase after 6 months, and to hire Bruce Whanger Jr. as a full time upon him turning 18 in November, at the rate of $12.50 per hour, with a .50 cent increase after 6 months.  The following roll call vote was recorded:  Roberts – aye, Ellison – aye, Williams – aye, Hale – aye.

 

There being no further business, a motion was made by Hale/Roberts to adjourn the meeting at 6:38 p.m.  Motion carried with 4 ayes and 0 nays.
